Privacy Policy

Your privacy is important to Proasia Design and its affiliates and/or subsidiaries. Proasia Design developed this privacy policy (the “Privacy Policy”) to protect information we may collect when you use the DiveSync application on iOS or Android (“DiveSync”). Please refer to the following provisions to understand how Proasia Design collects, processes, and uses, and under certain conditions, discloses, shares, or transfers your personal and non-personal information. By using DiveSync, you agree to the provisions of the Privacy Policy and authorize Proasia Design to collect, process, and use your personal data.

This Privacy Policy meets the obligations of applicable data protection laws such as the Data Protection Act, the General Data Protection Regulation (GDPR) for residents of the European Union, and the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) for residents of California.

1. Identity, Collection, Processing, Use and Recipients of Personal Data

We are the controller of your personal information and are responsible for using your personal data lawfully and transparently in alignment with the Taiwan Personal Data Protection Act and other applicable laws.

1.2 Personal Data Collected on DiveSync

When you use DiveSync, you may transmit data to us, revealing personal information (“Personal Data”). This can occur when your Personal Data is sent for troubleshooting purposes. We may collect:

Name, address, phone number, and email
Age, gender, and date of birth

The mandatory or optional nature of the Personal Data requested and the consequences of failure to provide it will be specified at the time of collection.

1.3 Purposes of Processing Personal Data on DiveSync

We process your Personal Data for the following purposes:

To answer your queries
To allow participation in interactive features of DiveSync
For internal operations, including troubleshooting and research
To comply with legal obligations and assist with crime prevention
To answer rights-related requests

Additional purposes include those defined by the Taiwan Ministry of Justice under the “Special Purposes of Personal Data Protection Act and Types of Personal Data.”

We rely on legal bases such as consent, legitimate business interests, and compliance with legal obligations to process your data.

1.4 Recipients of Personal Data

Proasia Design and its affiliates may share your information within the group only for purposes specified in this policy. We may disclose your information to:

Our cloud service provider
Law enforcement, regulators, courts, or advisors for legal compliance
Prospective buyers or business successors in case of a merger or acquisition
Legal advisors in connection with proceedings

We do not share your information with third parties for marketing purposes.

2. Where Personal Data is Stored

All information you provide is stored on Amazon Web Services (AWS) servers located in the United States. We ensure that AWS maintains strong security measures to prevent unauthorized access.

3. Retention of Personal Data

We will store your Personal Data as long as necessary to fulfill the purposes described above or to meet legal obligations. When no longer needed, data will be deleted or anonymized.

4. Your Rights

According to Article 3 of the Taiwan Personal Data Protection Act, you may:

Request access or a copy of your Personal Data
Request correction, deletion, or cessation of use

If your data is not provided, some services may not be available to you.

5. Privacy Rights of California Residents

California residents have rights under the CCPA and CPRA, including:

7. Cookies

DiveSync does not place cookies on your device.

8. Updates

Proasia Design may update this Privacy Policy periodically to reflect new features, legal requirements, or technical improvements. Updated versions will be posted on this page.
